These Terms & Conditions apply to all products and services offered by Studio Birth & Baby (“Studio Birth & Baby”, “we”, “us” or “our”). By purchasing a product or service from Studio Birth & Baby, you confirm that you have read and accepted these Terms & Conditions. These Terms & Conditions apply to consumers purchasing products or services from Studio Birth & Baby for personal use.

Nature of Our Services

Studio Birth & Baby provides educational information and online courses relating to pregnancy, birth, breastfeeding, parenting, babywearing and travelling with babies and young children.

Studio Birth & Baby does not provide midwifery care, medical treatment, diagnosis, medical advice or other healthcare services.

The information provided through our website, courses and other products or services is intended for educational and informational purposes only. It is not a substitute for personalised medical advice, diagnosis or treatment.

If you have medical concerns or questions relating to your pregnancy, birth, postpartum period, breastfeeding, or your own or your baby's health, you should consult your GP, midwife, obstetrician, paediatrician or other appropriately qualified healthcare professional.

You remain responsible for making your own decisions regarding your health and healthcare.

Information and Educational Content

We make every reasonable effort to ensure that the information provided through our website, courses and other services is accurate, current and based on reliable sources. However, healthcare knowledge, guidelines and professional practices may change over time. We therefore do not guarantee that all information will always be complete, current or free from errors. The information provided does not constitute individual medical advice and should not be relied upon as such. No rights may be derived from the educational information provided by Studio Birth & Baby beyond the rights expressly granted under these Terms & Conditions or applicable law.

Access to Online Courses

After successful payment, you will receive access to the online course you have purchased, subject to these Terms & Conditions. The standard access period for the following courses is 9 months:

• Birth Your Baby: 9 months

• Breastfeed Your Baby: 9 months

• Parent Your Baby: 9 months

• Travel Your Baby: 9 months

• Carry Your Baby: 9 months

The access period starts when access to the course is provided, unless otherwise stated at the time of purchase. Access is personal and may not be transferred to another person.

Studio Birth & Baby reserves the right to suspend or terminate access in the event of fraud, misuse of the platform, unauthorised sharing of login credentials, or other serious breaches of these Terms & Conditions. Such suspension or termination will not affect any mandatory consumer rights that cannot legally be excluded.

Login Credentials

Your login credentials are personal and must be kept confidential. You may not share your username, password or other access credentials with third parties. You may access and watch the course as often as reasonably necessary during the applicable access period. Studio Birth & Baby reserves the right to investigate unusual or excessive use of an account. If there are reasonable grounds to believe that an account is being shared, misused or used fraudulently, Studio Birth & Baby may suspend or terminate access.

Intellectual Property

All content made available through the Studio Birth & Baby website, online learning environment, courses and other products or services, including but not limited to text, photographs, illustrations, videos, audio, course materials, documents, graphics, logos and other materials, is protected by copyright and other intellectual property rights. Unless otherwise stated, these rights belong to Studio Birth & Baby or to the relevant third-party rights holder. You receive a limited, personal, non-exclusive and non-transferable right to access and use the course content for your own personal, non-commercial educational purposes during the applicable access period.

You may not, without prior written permission:

• copy or reproduce course content;

• distribute or share course content with third parties;

• publish or make course content available online;

• sell, rent, sublicense or otherwise commercially exploit course content;

• modify or create derivative works from course content;

• use course content to create another course, training programme, database or other product;

• record, reproduce or redistribute videos, audio or other course materials;

• share your account or login credentials with third parties.

You may not remove, alter or obscure copyright notices or other proprietary notices contained in the content.

Prices and Payment

The prices of our courses and other products or services are stated on the Studio Birth & Baby website at the time of purchase. Unless stated otherwise, all prices for consumers include 21% Dutch VAT (BTW). Payment must be made before access to an online course or other paid service is provided, unless an instalment payment option has explicitly been agreed. If payment in instalments is offered, the applicable payment schedule and conditions will be clearly communicated before purchase.

Right of Withdrawal

A General

If you purchase a product or service from Studio Birth & Baby as a consumer, you may have a statutory right of withdrawal (“cooling-off period”) under Dutch consumer law. For online purchases, the standard withdrawal period is generally 14 days. The exact starting point and applicable exceptions depend on the nature of the product or service purchased. Nothing in these Terms & Conditions is intended to restrict any mandatory statutory consumer rights.

B Digital Content and Immediate Access

Our online courses contain digital content that may be made available immediately after purchase. If you request that access to the digital content begins during the statutory withdrawal period, you will be asked for your express consent to immediate delivery. Where legally permitted, you will also be asked to acknowledge that, once delivery of the digital content begins with your express consent, you may lose your statutory right of withdrawal. The applicable information and consent will be presented during the purchase process.

C Exercising the Right of Withdrawal

If you have a statutory right of withdrawal and wish to exercise it, you may notify Studio Birth & Baby within the applicable withdrawal period. You may do so by contacting us by email: studiobirthandbaby@gmail.com

Where required by applicable law, Studio Birth & Baby will provide a refund within the applicable statutory period following a valid withdrawal. Refunds will be made using the same payment method used for the original transaction, unless otherwise agreed or legally permitted.

Cancellation and Refunds

Except where a refund is required under applicable law, payments for products or services are non-refundable once the applicable statutory withdrawal period has expired or where the consumer has validly waived the right of withdrawal in accordance with applicable law. If you experience technical problems that prevent you from accessing a purchased course, please contact us at studiobirthandbaby@gmail.com so that we can investigate and, where appropriate, provide a reasonable solution. Nothing in this section limits any statutory rights you may have regarding defective or non-conforming digital content or digital services.

Availability of the Website and Learning Environment

Studio Birth & Baby makes reasonable efforts to keep its website and online learning environment available and functioning properly. However, we do not guarantee that the website or learning environment will always be available, uninterrupted or free from technical defects. Temporary unavailability may occur, for example, due to maintenance, updates, technical failures, hosting problems, internet outages or circumstances beyond our reasonable control.

Where reasonably possible, we will take appropriate steps to restore access.

Third-Party Links

Our website or course materials may contain links to websites or resources operated by third parties. These links are provided for information and convenience only. Studio Birth & Baby does not control third-party websites and does not guarantee the accuracy, availability, security or content of those websites. The inclusion of a third-party link does not constitute an endorsement of the relevant website, organisation or information. Studio Birth & Baby is not responsible for the content or practices of third-party websites, subject to any liability that cannot legally be excluded.

Liability

Studio Birth & Baby is not liable for damage arising from the use of information provided through our website, courses, products or services, except where such liability cannot legally be excluded or limited. In particular, the information provided through our services is educational in nature and does not replace professional medical advice or treatment.

Nothing in these Terms & Conditions excludes or limits liability where such exclusion or limitation is prohibited by applicable law, including liability for intentional misconduct or gross negligence where such limitation is not legally permitted. Studio Birth & Baby shall not be liable for indirect or consequential loss to the extent that such exclusion is permitted under applicable law.

Complaints

If you have a complaint about our website, products, services or course content, please contact us as soon as reasonably possible. Complaints should be submitted in writing and should contain a clear and complete description of the issue.

We will acknowledge receipt of your complaint and aim to respond within 14 days. If a complaint requires more time to investigate, we will inform you and provide an indication of when you can expect a substantive response. We will make reasonable efforts to resolve complaints amicably. If a complaint cannot be resolved directly between you and Studio Birth & Baby, you may have the right to pursue the matter through the competent courts or another applicable dispute resolution procedure.

Applicable Law

These Terms & Conditions and the agreement between Studio Birth & Baby and the consumer are governed by Dutch law, subject to any mandatory consumer protection provisions applicable to the consumer. Nothing in these Terms & Conditions affects your mandatory rights as a consumer under the law applicable to you. Any disputes shall, subject to applicable consumer protection rules, be submitted to the competent court in the Netherlands.

Amendments to These Terms & Conditions

Studio Birth & Baby reserves the right to amend these Terms & Conditions from time to time. Any amended version will be published on the Studio Birth & Baby website. Changes will not affect rights or obligations that have already arisen before the amended Terms & Conditions take effect, unless otherwise required or permitted by applicable law. Where required by law, customers will be informed of material changes.
